The public parks of the city shall be open to the free use of all persons except between the hours of eleven p.m. and daylight the following morning.

No person shall enter any area or portion of any park set aside for amusement, concession or program where the same is enclosed by a fence, rope or signs, without first obtaining a permit from the authorized person in charge, or when an admittance fee is charged, first paying the admission fee.

No person shall be within the enclosed limits of the Council Grove swimming pool when the same is not in operation or open for business, unless the person is duly authorized as an employee, representative, or manager of the swimming pool or is making necessary repairs or maintenance upon said pool. No person shall knowingly and willfully throw or deposit any foreign substance within the water located in the Council Grove swimming pool, or in any other way disturb the operation of the Council Grove swimming pool.

(a) AUTHORITY TO BAN FROM PUBLIC PARKS. The head of the Council Grove Recreation Department or police officer for the City of Council Grove may ban any person from city parks for up to three days for inappropriate actions, including, but not limited to, fighting, abusive conduct, possession or consumption of alcohol, or any other activity which may be deemed inappropriate under the circumstances.
(b) EXTENDED BAN. Either the head of the Council Grove Recreation Department or the Chief of Police may request that the governing body of the City of Council Grove issue a ban for more than three days. Prior to the governing body making a determination of such extended ban, written notice shall be given to the banned person either by personally serving the notice or by mailing the same to the banned person’s last known address at least three days prior to the date of the hearing. Any person facing a ban for an excess of three days shall be given an opportunity to appear at the hearing to present evidence against the ban.
(c) PENALTY FOR FAILURE TO ABIDE BY BAN. Should any person banned from a park not abide by the order immediately upon receiving the same or should any person fail to abide by the ban for the stated period, such person shall be subject to prosecution for criminal trespass under the ordinances of the City of Council Grove.
