(a)   No person either as a principal or agent shall conduct business or carry on any type of business concerning the pumping or drainage of septic tanks within the city limits of the city or upon the Council Grove Lake Park without first securing from the city clerk of the city a license and a permit as hereinafter required.

(b)   All licenses shall be due and payable prior to the commencement of any business. When any license shall expire, the license for the ensuing period shall be due and payable. No license shall be issued until a fee has been paid as provided herein.

(c)   All licenses shall be issued for the calendar year and shall expire on the last day of December next after their issuance.

(d)   No license issued under the provisions of this article shall be transferable or assignable. There shall be no refunds and no license shall be prorated.

(e)   There is to be a license fee paid in the amount of $50 to be paid to the city clerk prior to obtaining the license.

The applicant shall post a bond in the amount of $500 for the faithful performance of the requirements of this article and for the disposal of the waste from the septic tanks or holding tanks as may be required by the State Board of Health and is to provide proof of liability insurance of an amount of not less than $25,000.

The person is required to secure a permit for each residence or septic tank upon which disposal is made from the septic tank and is to pay a permit fee in the amount of $7.50 to be paid to the city clerk. Before any permit can be issued, it will be necessary for the applicant to furnish the following information to-wit:

(a)   Name.

(b)   Address.

(c)   Telephone number.

(d)   Describe the type of equipment used.

(e)   Set out the period of time of which he or she has been in business.

(f)   Set out the location where the contents from the septic tanks or holding tanks are to be disposed.

(g)   Set out the approximate hour and location of which he or she proposes to provide service in pumping or emptying septic tanks or holding tanks, together with the cabin site and section number for the removal of the contents that are to be taken from the city lake and the lot, block and addition of which the property is to be taken from within the city limits of the city.

Any person attempting to do business with any individual whose septic tank is located within the city limits of the city or upon the Council Grove Lake Park shall be required to exhibit to the person a license and permit issued by the city clerk of the city before pumping, transporting, or in any way conducting any type of business concerning the removal of any contents of the septic tank or holding tank. A permit is required for each location of which a septic tank or holding tank is to be emptied or removed.
