There is hereby established a Municipal Court for the City of Council Grove, Kansas. The Municipal Court shall have jurisdiction to hear and determine cases involving violations of the ordinances of the City.

The Kansas code of procedure for municipal courts, as set forth in K.S.A. 12-4104 et seq. and all acts amendatory or supplemental thereto shall govern the practice and procedure in all cases in the Municipal Court.

The municipal court shall be presided over by a municipal judge. The mayor, with the consent of the council, shall appoint the municipal judge of the municipal court.

The municipal judge shall have such powers and duties as set forth in the Kansas code of procedure for municipal courts (K.S.A. 12-4101 et seq.) and all acts amendatory or supplemental thereto.

The municipal judge shall receive a salary as shall be fixed by ordinance.

Any written traffic citation given by any police officer of the city, when filed with the municipal court or municipal judge of the city, shall be deemed to be a lawful complaint for the purpose of prosecution for violation of the city ordinances and the uniform act regulating traffic on highways as provided by law.

The following court costs are hereby authorized for imposition in connection with proceedings in Council Grove Municipal Court, as follows:
(a) Court Docketing Fee - $75.00
(b) Warrant Fee - $50.00
(c) Expungement Fee - $40.00
(d) Video/DVD Fee in response to discovery - $20.00
(e) Insurance Company Records - $10.00

All fines, penalties, costs and fees collected by and paid to the municipal court and the judge thereof shall be, by the court and judge, paid over and remitted to the city treasurer, at least once each calendar month.

The municipal judge shall have the power to enforce due obedience of all orders, writs, rules and judgements made by him or her, and may fine or imprison, or both, for contempt offered such judge while holding his or her court, or to process issued by him or her, in the same manner and to the same extent as the district court, and for all such purposes, the jurisdiction of the municipal judge shall be coextensive with the District Court of Morris County, Kansas.
