The following words shall have the following meanings in reference to this article, to-wit:
(a) New Tires - Tires that have never been installed or run on any vehicle.
(b) Used Tires - A tire that has been removed from a wheel following a period of use or remains on a wheel removed from a vehicle and has been determined to have value in accordance with the rules and regulations established by Kansas law, K.S.A. 65-3424b(e)(7) or any amendments thereto.
(c) Waste Tires - A tire that has been removed from a wheel following a period of use or remains on a wheel removed from a vehicle following a period of use and is no longer suitable for its original intended purpose because of wear, damage or defect.
(d) Person - An individual or anyone acting under or at the direction of any type of entity.

Any new tires or used tires which are stored outdoors must be stored in such a manner as to remain free of water.

The maximum number of waste tires that may be possessed and stored outside by any person shall be 40 tires. All waste tires must be stored in such a condition as to remain free of water.

Any person found to be in violation of this section shall be subject to a fine of not less than $100.00 nor more than $500.00. Each day that a violation occurs shall be considered a separate violation of this article.
