A building trades board is hereby established for the purpose of examining and passing upon the qualifications of a person seeking licensing with the building trades as required by applicable ordinances; acting as an appeals board for persons aggrieved by a decision of the building official, or who feel the use of alternate materials or methods is justified, or feel these regulations do not adequately cover a point in question; and act as a code committee recommending to the governing body any changes necessary to keep the city codes governing the building trades current and up-to-date.

The board shall consist of six members appointed by the mayor and confirmed by the governing body of the city as follows: One building contractor; one electrical contractor; one plumbing contractor; one mechanical contractor and two members appointed at large from the city. The building official or his or her authorized representative will act as an ex officio member and shall be the board's secretary. All appointments shall be made for three-year terms, and with approval of the governing body, members' terms may be voluntarily extended up to 12 months to allow appointment of new members. No member shall be required to serve more than two consecutive terms without having a break of 12 months between two terms.

The board shall elect a chairperson and vice chair. Any action or recommendation of the board must be by majority of the entire board. The board shall adopt in writing a set of rules and procedures for conducting appeals hearings, and recommending code changes. A copy of such rules and procedures shall be available for the public in the city clerk’s office. The board is given the authority to appoint recommending committees as the need be. In conducting any business authorized by this article, the board shall be bound by the provisions of the regulations and any other ordinance or code of the city applicable to a particular trade.

The building trades board or any employee charged with the enforcement of the building code, acting in good faith and without malice or fraud for the city in the discharge of his or her duties shall not thereby render himself or herself liable personally and he or she is hereby relieved from all personal liability for any damage that may occur to persons or property as a result of any act required or by reason of any act or omission in the discharge of his or her duties. Any suit brought against the building official or employee, because of such act or omission performed by him or her in the enforcement of any provisions of the building code, shall be defended by the legal department of the city until final termination of the proceedings.

The board shall meet at least once each year for the purpose of recommending any changes to the city codes.
