Individuals and/or landowners whose property is annexed in the city will be subject to the requirements of service extensions as set forth herein.

The term special assessment is defined as payments made by the individual or landowner requesting services from the city and whereby the services may be paid either in a lump sum payment or over a period of time as may be specified by the city council, by city ordinance, state law or city action.

Sewer mains constructed in the area to be annexed will be provided when petitioned for by the owner of the real estate or upon the city council action, or as may be required by law or ordinance concerning the same. The cost of sewer maintenance extensions will be paid 100 percent by a special assessment of the cost up to an eight inch sewer line. The cost for any city sewer line if a size in excess of an eight inch line then the city will pay for the material cost in construction the sewer line in excess of eight inches in diameter.

City water mains will be constructed in the annexed area when petitioned for by the property owner or upon official action by the city council. The cost of the city water mains will be paid 100 percent by special assessment for construction costs of a water line up to six inches in diameter. Any city water main constructed in the annexed area which exceeds six inches in diameter, then the additional material costs for the larger water main will be paid by the city.

Fire hydrants will be installed at the city’s cost and expense when city water lines have been constructed in the annexed area to supply water for the fire hydrants.

Street improvements, extensions or upgrading streets in the annexed area will be done when petitioned for by the owners or upon approval of the city council. The costs of the construction of such streets will be by special assessments and will be paid 100 percent by the property owners.

Police protection will be provided immediately upon annexation at the cost and expense of the city.

Fire protection will be provided upon annexation in the city at no cost or expense to the owners, however, the city cannot provide fire protection from fire hydrants until adequate water lines and fire hydrants have been constructed.

Street lighting will be provided at the city’s cost and expense when a petition has been filed with the city council requesting a street light and the city council finds and deems it advisable for the installation of the street light.

All city codes will be enforced upon annexation into the city and the cost of enforcing the codes of the city will be as provided by city ordinances.

Refuse collection will be provided upon annexation into the city and the cost for refuse collection will e the same as that provided for by ordinance and available to all residents of the city.

Before any street is annexed into the city, it must meet standard compaction tests. The city requests AA compaction with soil density equal to or greater than 95 percent of standard proctor density. Thickness will vary with the type of soil and pavement. The petitioners will see that all city streets will meet the compaction tests. All embankments required for fill sections of roadbeds and fill requirements under the structure shall be compacted by rolling with a sheepsfoot roller or by mechanical tamping. The sheepsfoot roller, when fully loaded, shall have a loan on each tamper foot not less than 200 pounds per square inch of cross sectional area. Enough moisture shall be present in the soil to obtain a density equal to or greater than 95 percent of maximum density as determined by the standard proctor density test before placing the next lift. Each lift shall consist of level eight inch loose lifts or less prior to compaction.

Street surfacing shall be of materials, equipment and construction so as to conform with the standard specifications for state road and bridge construction as published by the Kansas Department of Transportation, hereinafter referred to as the Standard Specifications. Construction of bituminous mat base course and surfing consists of laying a hot, plant-mixed bituminous paving mixture of designated thickness. Material shall be heated and mixed in a central plant. Material shall be not less than 275 degrees when laid and compacted. Equipment shall be standard type suitable for the purpose of meeting construction guidelines.

The city council may accept a gravel street as a part of the annexed area into the city, however it must meet the base specifications along its entire length and width and have a gravel surface.

Any street before being annexed into the city having a hard surface must have minimum of a four inch asphalt surface as described herein.

Hard surface means a street that meets a base stand as set forth in this article and has a minimum bituminous asphalt mat of four inches.
